Reporting Copyright Infringement:

Once Proper Bona Fide Infringement Notification is Received by the Designated Agent:

The Company’s policy is as follows:

  1. We will promptly remove or disable access to any infringing material.
  2. We will notify the content provider, member, or user that we have taken action to remove or disable access to the material.
  3. Repeat offenders will have the infringing material removed from the system, and we will terminate the access of such content provider, member, or user to our service. 

Procedure to Supply a Counter-Notice to the Designated Agent:

To submit a counter-notice, the content provider, member, or user must provide the following information to the Designated Agent:

  1. A physical or electronic signature.
  2. Identification of the removed material and its previous location.
  3. A statement asserting a good faith belief that the material was removed or disabled due to a mistake or misidentification.
  4. The name, address, telephone number, and email address (if available) of the content provider, member, or user, along with a statement consenting to the jurisdiction of the Federal Court for the relevant district, or, if located outside the United States, consenting to the jurisdiction of any district in which the Company is located, and agreeing to accept service of process.

If a counter-notice is received, the Company may forward a copy to the original complainant, informing them that the removed material may be replaced or access restored within 10 business days unless the copyright owner files a court order against the content provider, member, or user. Restoration of the material may occur within 10 to 14 business days or more at the Company’s discretion, unless legal action is taken by the copyright owner.
